Agenda Item: Greetings and introductions

Chair Greg Chernack called the meeting to order and welcomed those in attendance.

Agenda Item: Review and Approval of December Council Meeting Minutes

Chair Chernack moved that the minutes from the December meeting be approved; there was a second, and the motion passed.

Agenda Item: Resident Comments

There were no resident comments.

Agenda Item: Consideration and Possible Adoption of Resolution No.: 5-18-1, an Emergency Ordinance to Regulate Small Wireless Telecommunications Facilities in the Rights-of Way Budget

Section 5 attorney, Ron Bolt, gave a presentation on the potential impact small cell wireless telecommunications and 5G will have on municipalities. He answered questions regarding the current status of proposed legislation in the state of Maryland and Montgomery County. He explained that the FCC issued an order in September significantly limiting local authority with respect to placement of small cell/DAS (distributed antenna systems) units in the public rights-of-way, but that allows local governments to adopt certain aesthetic standards. The September Order will go into effect January 14, but local governments will have until April 15 to adopt aesthetic standards. Considering these events, Council Chair Chernack moved that Resolution No.: 5-18-1, an emergency ordinance to regulate small wireless telecommunications facilities in the rights-of-way be approved; there was a second, and the resolution passed by unanimous vote. Councilmember Scott Livingston abstained from the vote. Chair Chernack then formally introduced Ordinance No. 1-19-1, a non-emergency ordinance to regulate small wireless telecommunications facilities in the rights-of-way that will be voted on at the February meeting.

Agenda Item: Monthly Financial Report

The Town Manager presented an overview of the Section’s current financial status, and entertained questions from the Council.

Agenda Item: Manager’s Report

-The Town Manager noted that there was no additional information to report.

-Chair Chernack added that his wife, Andra Chernack, recently hosted a gathering for residents interested in helping to plan Section 5 social events.


Chair Chernack adjourned the meeting. The next meeting will be held February 12, 2019, at 7:30 PM at the Village Hall, 5906 Connecticut Avenue. The Village Hall has handicapped access. Everyone is welcome.
